Terms of Service

Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and VibeSafely ("we", "us", "our") governing your use of vibesafely.com and the VibeSafely service (the "Service"). By creating an account, running a scan or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.

What the Service does

VibeSafely is a read-only security and quality scanner for web applications. It fetches pages and assets a target already serves publicly, inspects them, and produces a report of findings, scores and suggested fixes. It does not attempt to log in, modify data, submit forms, or perform destructive or denial-of-service testing.

Findings are provided for your information. They are generated automatically and may include false positives or miss issues; they are not a guarantee that a site is secure or compliant. You are responsible for validating findings and for the security of your own applications.

Accounts

• You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
• You must be at least 16 years old to use the Service.
• Notify us promptly at the contact below if you suspect unauthorized use of your account.

Authorized use only

You may only scan websites and applications that you own or are explicitly authorized to test. Scanning targets without authorization may violate computer-misuse and other laws, and is strictly prohibited. Our separate Acceptable Use Policy is part of these Terms and describes prohibited conduct in detail.

Plans, billing and refunds

• Your first scan is free. Paid plans are billed in advance on a monthly or annual basis through our payment processor.
• Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the current billing period.
• Fees are non-refundable except where required by law. We may change prices on renewal with reasonable notice.

Your content and our service

You retain ownership of the targets you submit and the reports generated for you. You grant us the limited rights needed to operate the Service (to run scans, store and display your reports, and improve the product using aggregated, de-identified data). We retain all rights in the Service, the scan engine and our content; these Terms grant you no rights in them except the right to use the Service as described.

Acceptable use

You agree not to misuse the Service — including scanning unauthorized targets, attempting to break or overload our systems, reselling or scraping the Service, or using it to violate the law or the rights of others. See the Acceptable Use Policy for specifics. We may suspend or terminate accounts that breach these rules.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that findings will be complete or accurate.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold us harmless from claims, losses and expenses arising out of your use of the Service, your content, or your breach of these Terms — including any scan you run without proper authorization.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service and its users. Provisions that by their nature should survive termination (such as ownership, disclaimers, limitation of liability and indemnification) will survive.

Changes to these terms

We may update these Terms as the product and the law evolve. When we make material changes we will update the date above and, where appropriate, notify you. Continued use of the Service after a change means you accept the revised Terms.

Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules. Nothing here limits any mandatory consumer rights you have under local law.
